Affiliate Agreement
This Affiliate Program Agreement goes into effect as soon as an affiliate acknowledges that he/she has read the Terms & Conditions. As soon as this is done, a new affiliate's status changes from approved to active. Active status allows Kids for God Movement, Inc. (KFGM) to make commission payments to Affiliates.
"Affiliate" means an individual generating his/her own traffic through a strong social media network of friends and family. Hence, the Affiliate receives monetary reward (commission) for legitimate sales, leads, clicks or other measurable action.
Enrollment In The Affiliate Program
- To begin the enrollment process, the Affiliate will submit a complete program application via KFGM's website.
- KFGM will evaluate Affiliate's application and notify Affiliate of acceptance or rejection.
- Company may reject an application for any reason at company's sole discretion.
- KFGM generally rejects applications related to websites that promote violence, discriminatiion (of any kind), illegal activities.
- Further, intent to harrass, defame anyone, variations, misspellings in an Affiliate's domain name or otherwise company's intellectual property rights or the intellectual property rights of others will result in the company's decision to reject applicants.
Affiliate Responsibilities:
- Understand that an Affiliate shall oversee and pass the KFG'M's "Get Your Pin & Be In" Campaign through his/her social media network. An Affilliate will use a special email code to execute this procedure.
- Further, the "Company" (herein known as Kids for God Movement) will issue each Affiliate a special email code upon joining. It will then be the responsibility of each Affiliate to make certain that he/she sends the special email code throughout his/her social media network.
- "Company" reserves the right to accept or reject any prospective customers and will pay Affiliates a commission per referred customer. This is done when an Affiliate uses his/her code according to the designated payment schedule.
Service:
Any Affiliate Program may be amended or terminated at any time. Information about the Affiliate program is available only on KFGM's website.
In Addition, an Affiliate must keep himself/herself informed of any amendments of the existing Affiliate Program - particularly if a registered website has terminated its Affiliate Program or changed the conditions for remunderation to Affiliates.
Also, an Affiliate must comply with the requirements of the Affiliate Program, including any stipulations as to the nature and content of the Affiliates website as well as the use of third party or other affiliate trademarks or logos.
Terms Of The Agreement
The terms of this Agreement will begin upon the "Company" accepting a new Affiliate's Program Application.
- An Affiliate earns Commision Fees based on quarterly minimum purchases of 100 + KFGM Lapel Pins. KFGM will pay Affiliates on a quarterly basis provided they have met the minimum sales quota requirement. Also, Commission Fees that Affiliates earn through the date of termination will remain payable only if the orders for the related products and services are not cancelled and comply with all Terms laid out in this Agreement.
- KFGM may withhold final payment of Commission Fees for a reasonable time to ensure that all qualified purchases are valid, and payment from Referred Customers are legitimate as determined by KFGM in its sole discretion.
- Any Affiliate who violates either this Agreement or Company's Terms and Conditions will immediately forfeit any right to any and all accrued Commission Fees and active status as a KFGM Affiliate. Without limitation, an Affiliate's participation in the Program and, this Agreement, shall no longer exist. Furthermore, all Commission Fees will be forfeited upon Affiliate's violation of any of the Terms of this Agreement or of any applicable law or regulation having the force of law.
Confidentiality:
Only duly-authorized company officers, employees and agents will have access to information furnished or obtained in connection with the test. In additiion, they will maintain and protect the confidentiality of such information to the greatest extent possible. Also, shared information is only used to the extent necessary to make employment decisions and respond to inquiries or notices from government entities.
Indemnification:
- Affiliates hereby agree to indemnify and hold harmless "Company" and its subsidiaries, affiliates, directors, officers, employees, agents, shareholders, partners, members and other owners against any and all claims, actions, demands, liabilities, losses, damages, judgments, settlements, costs and expenses (including reasonable attorney's fees) - any or all of the foregoing herein after referred to as "Losses" - insofar as such losses or actions in respect thereof arise out of or are based on:
- Any claim that "Company" use of the Affiliate Trademarks infringes on any Trademark, trade name, service mark, copyright, license, intellectual property, or other proprietary right of any third party.
- Any misrepresentation of a representation or warranty or beach of a covenant and agreement made by the Affiliate herein.
- Claims related to an Affiliate's site, including - without limitation - its development, operation, maintenance and content therein not attributable to the "Company".
